When you need an alternative to time consuming and often, costly litigation, Alternative Dispute Resolution, commonly referred to as "ADR" may be the answer to resolving your civil or commercial dispute.
Mediation is one of a variety of ADR techniques employed for effectively and efficiently resolving disputes without full-scale litigation in court.
Mediation is a process in which parties involved in a dispute meet voluntarily with a trained, neutral mediator, who works to assist the parties in reaching agreement. The parties may be two individuals or companies or if the case is complex, may involve multi-parties. Clients who choose mediation are able to resolve their differences in a private setting, unlike a courtroom, which opens your case not only to public exposure, but also media attention for high profile individuals and corporations. Mediation can resolve disputes more quickly than in court and has been known to preserve business or family relationships, which otherwise may have been destroyed by a lawsuit.
Mediation is sometimes used in combination with arbitration. The disputing parties may agree at the outset that if the mediator does not succeed in finding a solution acceptable to all parties, the mediator or another mediator will be chosen to act as arbitrator, making a final decision for the parties.
